PETITION FOR COMMON SENSE REGULATION OF THE
ELECTRONIC CIGARETTE INDUSTRY
Whereas, the Electronic Cigarette Industry is a small but growing sector of the United States Economy, and,
Whereas, electronic cigarettes, unlike other cigarette alternatives such as cigars and smokeless tobacco, offer consumers an activity similar to smoking without the negative consequences of tar and second-hand smoke, and
Whereas, efficient and appropriate regulation of such a new industry involving nicotine delivery is required, and,
Whereas, the health and well-being of children and families is of the utmost importance to all citizens of the United States and members of the electronic cigarette industry, and
Whereas, electronic cigarettes should not be sold to persons under 18 years of age, Now, therefore be it resolved that electronic cigarettes should not be sold to any person for individual consumption except in the physical presence of a clerk or sales representative tasked with checking a legal method of age verification using accepted form of identification such as a drivers’ license,
And, furthermore, that no sale of electronic cigarette shall be made on the Internet,
And, furthermore, no local government shall ban the sale of electronic cigarettes to the public when a transaction occurs in the manner.

ALABAMA
House Bill 383 – No action this week. This bill would prohibit smoking in places of employment and public places. The ban would include e-cigarettes.

Senate Bill 197 – No action this week. Proposes an amendment to the Constitution of Alabama of 1901, to repeal the Alabama Clean Indoor Air Act and establish the Alabama Smoke-free Air Amendment of 2012, prohibiting smoking in places of employment and public places, including certain outdoor areas. This ban would include the use of electronic cigarettes in public places.

VERMONT
H 747- Hearing: Committee on Economic Development, Housing and General Affairs 3/23/2012. This bill proposes to clarify the circumstances under which a tobacco product manufacturer may be listed on the attorney general’s tobacco directory. It also prohibits e-cigarette sales in Vermont through the Internet and classifies e-cigarettes as tobacco products, creating new regulatory and tax obligations.
