ECIG advocates for reasonable regulation of electronic cigarettes and supports laws that prevent minors from accessing them. ECIG is working with manufacturers, importers and distributors of electronic cigarettes to ensure fair, balanced state and federal regulations and provide compliance assistance to members.

The passage of the Family Smoking Prevention and Tobacco Control Act of 2009 (FSPTCA) gave the Food and Drug Administration (FDA) the authority to regulate the manufacture, distribution and marketing of “made or derived from tobacco”. The FDA sent a letter to stakeholders regarding its intent to propose a regulation that would extend the Agency’s “tobacco product” authorities to other categories of tobacco products and specified their intention to regulate electronic cigarettes.

In July 2013, the FDA released its annual Regulatory Agenda stating the agency would be issuing Notice of Proposed Rulemaking (NPRM) by October 2013 which would allow public will have a period of time to comment on the proposed regulations. Based on statements and the current regulation of tobacco products, we anticipate similar general controls, such as registration, product and ingredient listing, manufacturing requirements, licensing/user fees and misbranding provisions.

ECIG will review any proposed electronic cigarette rules and regulations for e-cigarettes for legal and scientific implications and points of concern and report to its members for assistance in responding.

ECIG’s proactive approach to representing the electronic cigarette industry by educating and establishing relationships with state and federal agencies allows the organization to provide informational and compliance resources for its members.

ECIG is working to prevent state and local municipalities from including electronic cigarette use in indoor smoking bans, advocating for fair, balanced tax policies that encourage smoke-free alternatives and supports prohibiting sales of tobacco and nicotine products to minors.
